Through various
examples, this presentation will provide insights into how statements made
and actions taken during prosecution
impact litigation, particularly during claim construction and arguments reg
arding invalidity. Presenter: Niky Bagley
Niky's practice is focused on
patent and other intellectual property litigation in a variety of forums.
She has litigated a wide range of cas
es on both the plaintiff and defense side, primarily involving the electron
ic arts and software design and application, including microprocessors and integrated circuits, sensors and dete
ctors, virtual reality interfaces, encryption algorithms, artificial intell
igence, mapping architecture and programs, security systems, and mechanical devices — to name a few. She represe
nts clients before Federal District Courts across the country, the Internat
ional Trade Commission, and the Patent Trial and Appeal Board in post gran
t proceedings. Her extensive trial experience puts her in a unique position
to analyze and evaluate intellectual property litigation from inception to
termination.
Additionally, Niky pract
ices before the Patent and Trademark Office. In conjunction with traditiona
l patent and trademark prosecution, Niky assists her clients with patent an
d intellectual property strategy and complex portfolio development and mana
gement. She also uses her broad and comprehensive experience when advising
clients on how to effectively license and monetize their intellectual prope
rty assets.
Previously, Niky worked with the Washington State Attorney Gene
ral's Office. As an Assistant Attorney General, she represented various sta
te agencies in civil proceedings. She litigated numerous trials, represente
d the State in various motions and hearings, argued cases before the Washin
gton Court of Appeals, and represented the State before the Washington Supr
eme Court.
Niky proudly serves as an Ad
junct Professor at Texas A&M School of Law and is a contributor to scho
larly discourse. She is also involved in a variety of community organizatio
ns, including active membership with the Texas Patent Pro-bono Advisory Com
mittee, the Dallas Bar Association’s Intellectual Property Council, the Dal
las IP CLE Committee, and the State Bar of Texas Patent Committee. Niky was
named a 2019-2020 Global Fellow of the Federal Circuit Bar Association.
